VIDEO CLOSINGS
 
As a result of the Governor’s Executive Order No. 03.31.20.01, we are temporarily implementing an as-needed video-closing process.
 
Inevitably, video closings and notarizations create unforeseen inefficiencies and create greater opportunity for error and fraud.  However, we will continue doing everything possible in this challenging season to avoid undue delay in transactions.
 
Please note, our process for a video closing may not be the exact same as other firms.  We are closely following ever-changing emergency orders, related regulations, and guidance from the lenders and title insurance underwriters.  We ask for your patience as this is a new dynamic in our state.  
 
In the event a video closing is requested, we will first confirm if the lender (as applicable) will permit a virtual closing.  Prior to a scheduled video closing, documents for closing will be shipped by overnight delivery. Additionally, we will email downloading instructions and an invitation link to the signer.  DOCUMENTS MUST NOT BE SIGNED PRIOR TO THE LIVE VIDEO CLOSING.  
 
Signing parties will be required to produce two forms of identification.  Sellers signing by video may need to produce a utility bill for the property being sold.  All parties on a video closing MUST BE PHYSICALLY LOCATED WITHIN THE STATE OF GEORGIA and will be required to sign a certification confirming their physical location during the closing.
 
Original, signed documents will then be returned to our office by overnight delivery via a shipping label we will provide.  Upon receipt, we will notarize and witness these documents. Funds will be disbursed when a) all documents are received and reviewed for proper signature, b) documents are witnessed and notarized at our office and c) the lender (if any) has authorized funding.
 
Finally, please note we will be utilizing Microsoft Teams as our video platform.  We have confirmed the required security and recording protocols this software provides in order to diligently guard against fraud.  FaceTime or other video applications are not acceptable.
 
As previously mentioned, a lender must approve a video closing.  In the event a lender does not approve a video closing, we will continue to operate in our customary manner.  Real estate transactions are an “essential service” and therefore it is permissible to conduct a closing in person should a buyer and/or seller so desire.  WE WILL CONTINUE TO IMPLEMENT ALL RECOMMENDED CDC PRECAUTIONS AND SANITATION MEASURES.
